NIW

National interest waiver

An NIW sits on top of EB-2. You first show that you are a professional with an advanced degree, or that you have exceptional ability. You then address the three national-interest considerations for the work you propose. If the waiver is granted, a job offer and a labor certification are not required.

01 PROFILE

A solid record, and future work with public or industry value

Researchers, engineers, clinicians and educators with an advanced degree and a continuing record in the field
Technical, commercial, artistic or cross-disciplinary professionals who can show exceptional ability
Founders, industry specialists and innovators with a clear plan for work in the United States
People whose work can matter more widely for the economy, public health, technology, security, education, culture or a critical industry
02 FRAMEWORK

EB-2 eligibility, plus the three national-interest considerations

An NIW is not a general claim that you are excellent. It is a specific proposed endeavor, a showing that you are well positioned to advance it, and a reason why waiving the job offer and labor certification would benefit the United States.

01

Substantial merit and national importance

Define the future work clearly, and show industry, social, research, economic or public value that is not limited to one employer.

02

Well positioned to advance it

Use education, results, progress, a support network, funding, customers, collaboration and the past record to show the plan can actually be carried out.

03

On balance, beneficial to the United States

Explain why, on these facts, waiving the job offer and labor certification lets the United States benefit from the contribution.

03 EVIDENCE

Evidence that can be organised into the petition

More paper is not better evidence. Each item needs a source, a reason to trust it, a link to you, and a reason it meets the point you are making.

01

Degrees, licences, work history and the EB-2 advanced-degree or exceptional-ability base

02

A clear proposed endeavor statement, staged goals and a plan for the United States

03

Papers, citations, patents, products, projects, revenue, customers or adoption in the field

04

Government, industry, academic or market material on why the field matters nationally

05

Letters of interest, collaboration, funding, investment, a business plan and other early progress

06

Expert letters and independent comment on your ability and the likely effect of the work

PERSONAL ASSESSMENT

A checklist cannot score a career. The record has to be read as a case.

QUESTIONS & ANSWERS

US EB-2 NIW: common questions

How does NIW relate to EB-2?

NIW is a national interest waiver, inside EB-2, of the job offer and labor certification. You still need the EB-2 base: an advanced degree as a professional, or exceptional ability in the sciences, arts or business, plus evidence for the waiver itself.

Can I file an NIW myself?

Yes. You may file Form I-140 yourself and submit evidence on the national interest, requesting a waiver of the job offer and labor certification. Filing yourself does not remove the eligibility or evidence requirements.

How does GEA Talent help shape the proposed endeavor?

We start from the work you have actually done, then define the specific endeavor, the goals, the record so far and the steps that can be carried out in the United States. The work can include English drafts of the endeavor, letters and evidence captions, and document support alongside counsel you instruct.
